ScotPlants Direct – Terms and Conditions of Sale

Thank you for shopping with ScotPlants Direct, a trading name of Glenmore Group Ltd.
By purchasing plants or related products from ScotPlants Direct, you agree to the following Terms and Conditions, which form a legally binding contract between you (the customer) and us (the seller). Please read these Terms carefully before placing an order.

·       You / Customer

The person or business placing an order and accepting these Terms.

·       Contract

The legally binding agreement for the sale and purchase of products incorporating these Terms.

·       Products

Plants, trees, and any other goods supplied by ScotPlants Direct.

·       Order

Your request to purchase Products from us, submitted online, by phone, or by email.

·       Delivery Area

Addresses within the United Kingdom, excluding the Channel Islands and certain remote locations where courier access or pallet delivery is not possible.

• The description, price, and quantity of Products are shown on the website at the time of ordering or confirmed in writing if ordered by phone or email.
• We make every effort to ensure the accuracy of information and images on our website, but as plants are living products, natural variations in size, colour, and form are to be expected.
• Plant sizes are approximate and may vary slightly depending on the season.
• Orders are accepted at our discretion and subject to stock availability. A Contract is formed only when we confirm your Order by email.
• If we are unable to fulfil your Order, we will inform you and refund any payment received.

If you wish to amend your Order, please contact us as soon as possible.
We will confirm whether the change is possible and advise of any adjustments to price, delivery, or timescales. If changes are not acceptable to you, you may cancel the Order before it is dispatched.

• All prices include VAT (where applicable).
• Payment is taken in full at the time of ordering.
• We reserve the right to correct any pricing errors before accepting your order. If this occurs, you will be notified and given the option to proceed or cancel.
• If the VAT rate changes between order and delivery, the rate applied will be the one in effect at the time of payment.

• Deliveries are made to the address provided at checkout. Please ensure this is accurate and that access is suitable for couriers or pallet vehicles.
• Standard delivery times are usually 2–5 working days, although this may extend during peak seasons (spring and autumn).
• Delivery delays may occur due to carrier network issues or seasonal demand. We cannot accept liability for costs incurred due to delayed delivery.
• Orders are shipped as No Signature Required, and if no one is present, the courier may leave the goods in a safe location.
• Large orders may be delivered on pallets. Couriers will offload the pallet but will not unpack or move products beyond the kerbside.
• If you fail to take delivery or provide incorrect delivery information, we may charge additional redelivery or storage fees.

Ownership of Products passes to you once payment has been received in full.
Responsibility for the Products transfers to you upon delivery. You are responsible for their care, watering, and maintenance thereafter.

We take great care to supply healthy, high-quality plants.
If you believe an item is faulty, damaged, or not as described, contact our team immediately at info@scotplantsdirect.co.uk with photos and order details.

Please note:

• Perishable goods (plants, trees, turf, etc.) cannot be returned if you change your mind, over-order, or purchase in error.
• Non-perishable goods (e.g. accessories, fertilisers) can be returned within 14 days, but both outbound and return delivery costs will be deducted from any refund.
• Returned goods remain your responsibility until received by us.

We also offer a 12-month Plant Guarantee when our recommended planting accessories are purchased and our planting guidelines are followed. For full details, see our Plant Guarantee Policy.

• We have informed you of a change to these Terms or pricing that you do not accept.
• Delivery is significantly delayed due to factors beyond our control.
• You are exercising your legal right under the Consumer Contracts Regulations (for non-perishable goods only).

For unwanted, surplus, or incorrectly ordered plants, collection and original delivery costs will apply.

To cancel your Order, contact us via email at info@scotplantsdirect.co.uk or by post at our registered address.
If the Products have already been dispatched, you must return or allow collection within 5 working days of cancellation.
Refunds will be processed within 14 working days of receiving returned goods or confirmation of collection.

We may cancel your Order and refund you if:

• Payment is not received,
• You fail to provide correct delivery details or accept delivery, or
• The Products become unavailable or are withdrawn from sale.

If you misuse or damage Products before return, we reserve the right to deduct reasonable compensation.

We are responsible for loss or damage that is a foreseeable result of our breach of this contract or failure to use reasonable care and skill.
We do not accept liability for indirect or consequential loss, including loss of profit, goodwill, or business opportunity.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, or for fraud.
Products are sold for domestic and private use only.

All content on the ScotPlants Direct website (text, images, and trademarks) is protected by copyright. You may print information for personal use only.
Links to external websites are provided for convenience, and we are not responsible for their content accuracy

Your personal information is used only to fulfil your order and communicate relevant updates.
We comply with the UK General Data Protection Regulation (UK GDPR).
We do not share your data with third parties except where required by law or necessary for delivery and payment processing.

• We may transfer our rights under this Contract to another entity, provided your rights are not affected.
• If any clause is found invalid, the remainder of these Terms remains enforceable.
• Failure to enforce any part of this Contract does not waive our right to do so later.
